Harassment Is The Campaign, Not The Single Post
Under Florida law, harassment is a course of conduct aimed at a specific person that causes substantial emotional distress and does not serve any legitimate purpose. Cyberstalking is that course of conduct through electronic communication. See section 784.048, Florida Statutes.
What We See
- Tagging after a block.
- Livestream comments.
- Fake accounts.
- Threats to publish more. A threat to publish can be evidence of intent.
- Messages to the client’s customers or talent.
- Posts meant to follow the client to work or to court.
Some of it is defamation. Some of it is a petition for protection against stalking under section 784.0485, Florida Statutes. That injunction is a public record. Some of it is both.
How We Stop It
- Demand and takedown. We send the cease-and-desist the same week when the record supports it, and we press the platform to remove the posts.
- Stalking injunction. When the facts fit section 784.0485, we petition. The injunction is entered against the other party by name.
- Tortious interference. When the audience is a board, an employer, a customer list, or a talent pool, the same facts can support interference with a business relationship. Competition is lawful. Publishing a false statement of fact to the people the client does business with is not.
We do not sell monitoring packages or private-investigation add-ons.
